مع عدم الاخلال بأية عقوبة أشد منصوص عليها فى قانون العقوبات أو فى أى قانون آخر يعاقب بالحبس مدة لا تجاوز ستة أشهر وبغرامة لا تزيد على خمسين جنيها أو بإحدى هاتين العقوبتين فضلا عن وجوب الحكم بمصادرة ما يضبط من طوابع، كل من يخالف أحكام المادة ٢ وكذلك كل من عرض للبيع طوابع بغرض إعادة استعمالها مهما تكن طريقة صنعها، تشبه بهيئتها الظاهرة طوابع البريد المتداولة أو التذكارية مشابهة يسهل معها قبولها بدلا من الطوابع الصحيحة.
