يجوز لمجمعة التأمين المعنية أن ترجع على المؤمن له بقيمة ما تكون قد أدته من مبلغ التأمين إذا ثبت أن التأمين قد عقد بناء على إدلاء المؤمن له ببيانات كاذبة أو إخفائه وقائع جوهرية تؤثر فى حكم مجمعة التأمين المعنية على قبولها تغطية الخطر أو أن المركبة استخدمت في أغراض لا يخولها الترخيص .
