يتحدد حجم أعمال المشروع، فى تطبيق أحكام المادتين (٩٣،٩٤) من هذا القانون،
وفقا لأى من المعايير الآتية :
١ - بيانات آخر ربط ضريبى نهائى للممول المسجل لدى مصلحة الضرائب فى تاريخ
العمل بهذا القانون .
٢ - بيانات أول إقرار ضريبى يقدمه الممول المسجل لدى مصلحة الضرائب المصرية
ولم يحاسب ضريبيا حتى تاريخ العمل بهذا القانون .
٣ - بيانات الإقرار الذى يقدمه الممول الذى يسجل ضريبيا بعد تاريخ العمل
بهذا القانون .
ويحدد حجم أعمال المشروع الخاضع للمعاملة الضريبية المبسطة كل خمس سنوات
من واقع ما تجريه مصلحة الضرائب المصرية من فحص، ويحاسب الممول ضريبيا
فى السنوات الخمس التالية على أساس نتيجة الفحص .
