إذا لم يوفق المشروع أوضاعه خلال مدة سريان الترخيص المؤقت ولم يقدم مبررات مقبولة لذلك، كان للجهة صاحبة الولاية، بعد موافقة الجهاز، فسخ عقود التخصيص التى أبرمت وفقا لأحكام المادة (٧٥) من هذا القانون، ولجهات الولاية استرداد العقارات وفقا للقواعد المقررة فى هذا الشأن .
