يقع باطلا كل تصرف أو ترتيب حق عينى على العقار أثناء مدة التخصيص المؤقت بغير موافقة الجهة مقدمة التمويل والجهة صاحبة الولاية ، ولا يجوز إشهاره .
ومع مراعاة حكم الفقرة الأولى ، يجوز للمشروع التنازل عن عقد التخصيص إلى الغير أو إلى ذات الجهة مقدمة التمويل المخصص باسمها العقار تخصيصا مؤقتا .
