للجهة صاحبة الولاية ، بقرار مسبب ، مباشرة إجراءات البيع نيابة عن الجهة مقدمة التمويل بعد مضى ثلاثين يوما من تاريخ إنذارها رسميا ، وذلك حال امتناع الجهة مقدمة التمويل بغير مبرر مقبول عن البدء فى اتخاذ إجراءات البيع خلال المواعيد المنصوص عليها فى المادة (١٠) من هذا القانون .
وتلتزم الجهة صاحبة الولاية بإعلان الجهة مقدمة التمويل بجميع الإجراءات وميعاد جلسة البيع .
