إذا استلزم إثبات الحالة الاستعانة بطبيب أو غيره من الخبراء ، يجب على قاضى التحقيق الحضور وقت العمل وملاحظته .
وإذا اقتضى الأمر إثبات الحالة بدون حضور قاضى التحقيق نظرا إلى ضرورة القيام ببعض أعمال تحضيرية أو تجارب متكررة أو لأى سبب آخر وجب على قاضى التحقيق أن يصدر أمرا يبين فيه أنواع التحقيقات وما يراد إثبات حالته .
ويجوز فى جميع الأحوال أن يؤدى الخبير مأموريته بغير حضور الخصوم .
