يجب لرد الاعتبار :
( أولا ) أن تكون العقوبة قد نفذت تنفيذا كاملا ، أو صدر عنها عفو
أو سقطت بمضي المدة .
( ثانيا ) أن يكون قد انقضى من تاريخ تنفيذ العقوبة أو صدور العفو
عنها مدة ست سنوات إذا كانت عقوبة جناية ، أو ثلاث سنوات إذا
كانت عقوبة جنحة ، وتضاعف هذه المدد في حالتي الحكم للعود وسقوط
العقوبة بمضي المدة .
