لا يجوز التفتيش إلا للبحث عن الأشياء الخاصة بالجريمة الجارى جمع الاستدلالات أو حصول التحقيق بشأنها .
ومع ذلك إذا ظهر عرضا أثناء التفتيش وجود أشياء تعد حيازتها جريمة ، أو تفيد فى كشف الحقيقة فى جريمة أخرى ، جاز لمأمور الضبط القضائى أن يضبطها .
