للنيابة العامة في الأحوال التي يجوز فيها تأجيل تنفيذ
العقوبة على المحكوم عليه أن تطلب منه تقديم كفالة بأنه لا يفر من التنفيذ
عند زوال سبب التأجيل ، وتقدر مبلغ الكفالة في الأمر الصادر
بالتأجيل .
ولها أيضا أن تشترط لتأجيل التنفيذ ما تراه من الاحتياطات الكفيلة
بمنع المحكوم عليه من الهرب .
