إذا توفي المحكوم عليه ولم يكن الطلب مقدما من أحد
الأقارب أو الزوج ، تنظر المحكمة الدعوى في مواجهة من تعينه للدفاع عن
ذكراه ، و يجوز بقدر الامكان من الأقارب . وفي هذه الحالة تحكم عند
الاقتضاء بمحو ما يمس هذه الذكرى .
