إذا كان الحكم صادرا بعقوبة الإعدام ، فعلى المحامى الذى قام بالدفاع عن المتهم موكلا كان أو معينا أن يقوم بإجراءات الطعن بطريق النقض إذا كان لذلك وجه ، وهذا بغير إخلال بما للمحكوم عليه من الحق فى رفع الطعن بنفسه أو بواسطة محام آخر .
