لرجال السلطة العامة ، فى الجنح المتلبس بها التى يجوز الحكم فيها بالحبس ، أن يحضروا المتهم ويسلموه إلى أقرب مأمور من مأمورى الضبط القضائى .
ولهم ذلك أيضا فى الجرائم الأخرى المتلبس بها إذا لم يمكن معرفة شخصية المتهم .
