إذا حكم على عدة متهمين بحكم واحد لجريمة واحدة ، فإنهم كانوا أو شركاء ، فالمصاريف التى يحكم بها تحصل منهم بالتساوى ، ما لم يقض الحكم بتوزيعها بينهم على خلاف ذلك ، أو بإلزامهم بها متضامنين .
