إذا امتنع الشاهد عن أداء اليمين أو عن الإجابة فى غير الأحوال التى يجوز له قانونا ذلك ، حكم عليه فى مواد المخالفات بالحبس مدة لا تزيد على أسبوع أو بغرامة لا تزيد على جنيه مصرى ، وفى مواد الجنح والجنايات بالحبس مدة لا تزيد على ثلاثة أشهر أو بغرامة لا تزيد على ستين جنيها .
وإذا عدل الشاهد عن امتناعه قبل إقفال باب المرافعة يعفى من العقوبة المحكوم بها عليه كلها أو بعضها .
