يجب أن تكون الجلسة علنية ، ويجوز للمحكمة مع ذلك مراعاة للنظام العام أو محافظة على الآداب ، أن تأمر بسماع الدعوى كلها أو بعضها فى جلسة سرية ، أو تمنع فئات معينة من الحضور فيها .
