إذا ترك المدعى بالحقوق المدنية دعواه المرفوعة أمام المحاكم الجنائية ، يجوز له أن يرفعها أمام المحاكم المدنية ما لم يكن قد صرح بترك الحق المرفوع بالدعوى .
