لكل من المتهم والمسئول عن الحقوق المدنية والنيابة العامة أن يعارض فى الجلسة فى قبول المدعى بالحقوق المدنية إذا كانت الدعوى المدنية غير جائزة أو غير مقبولة . وتفصل المحكمة فى المعارضة بعد سماع أقوال الخصوم .
