إذا كان من لحقه ضرر من الجريمة فاقد الأهلية ولم يكن له من يمثله قانونا ، جاز للمحكمة المرفوعة أمامها الدعوى الجنائية بناء على طلب النيابة العامة أن تعين له وكيلا ليدعى بالحقوق المدنية بالنيابة عنه . ولا يترتب على ذلك فى أية حال إلزامه بالمصاريف القضائية .
