تسرى على الشهود فى التحقيق الذى تجريه النيابة العامة الأحكام المقررة أمام قاضى التحقيق .
ويكون الحكم على الشاهد الذى يمتنع عن الحضور أمام النيابة العامة ، والذى يحضر و يمتنع عن الإجابة ، من القاضى الجزئى فى الجهة التى طلب حضور الشاهد فيها ، حسب الأحوال المعتادة .
