لمن لحقه ضرر من الجريمة أن يدعي بحقوق مدنية أثناء التحقيق في الدعوى وتفصل النيابة العامة في قبوله بهذه الصفة في التحقيق خلال ثلاثة أيام من تقديم هذا الادعاء ولمن رفض طلبه الطعن في قرار الرفض أمام محكمة الجنح المستأنفة منعقدة في غرفة المشورة خلال ثلاثة أيام تسري من وقت إعلانه بالقرار.
