يجوز الصلح فى مواد المخالفات إذا لم ينص القانون فيها على عقوبة الحبس بطريق الوجوب أو على الحكم بشىء آخر غير الغرامة أو الحبس .
ويجب على محرر المحضر فى الأحوال السابقة أن يعرض الصلح على المتهم ويثبت ذلك فى المحضر ، وإذا لم يكن المتهم قد سئل فى المحضر ، وجب أن يعرض عليه الصلح بإخطار رسمى .
