لمحكمة الجنايات أو محكمة النقض فى حالة نظر الموضوع إذا وقعت أفعال من شأنها الإخلال بأوامرها أو بالاحترام الواجب لها ، أو التأثير فى قضائها ، أو فى الشهود ، وكان ذلك فى صدد دعوى منظورة أمامها أن تقيم الدعوى الجنائية على المتهم طبقا للمادة ٢١
