إذا حضر الشاهد أمام القاضى بعد تكليفه بالحضور ثانيا أو من تلقاء نفسه وأبدى أعذارا مقبولة ، جاز إعفاؤه من الغرامة بعد سماع أقوال النيابة العامة ، كما يجوز إعفاؤه بناء على طلب يقدم منه إذا لم يستطع الحضور بنفسه .
