يسمع قاضى التحقيق شهادة الشهود الذين يطلب الخصوم سماعهم مالم ير عدم الفائدة من سماعهم .
وله أن يسمع شهادة من يرى لزوم سماعه من الشهود عن الوقائع التى تثبت أو تؤدى إلى ثبوت الجريمة وظروفها و إسنادها إلى المتهم أو براءته منها .
