لا يمنع الأمر بالرد ذوى الشأن من المطالبة أمام المحاكم المدنية بما لهم من حقوق ، وإنما لا يجوز ذلك للمتهم أو المدعى بالحقوق المدنية إذا كان الأمر بالرد قد صدر من المحكمة بناء على طلب أيهما فى مواجهة الآخر .
