مع عدم الإخلال بأحكام القانون رقم 49 لسنة 1977 في شأن تأجير وبيع الأماكن وتنظيم العلاقة بين المؤجر والمستأجر وقانون حماية الآثار الصادر بالقانون رقم 117 لسنة 1983 تسري أحكام هذا القانون على المباني والمنشآت غير الآيلة للسقوط، وكذا المباني والمنشآت التي يتوافر فيها أحد الأوضاع المبينة في الفقرة الأولى من المادة الثانية من هذا القانون أيا كان موقعها أو مالكها.
