استثناء من أحكام المادة السابقة يقبل قيد الحقوق استنادا إلى وضع اليد المكسب للملكية إذا رفعت الدعوى أو صدر الحكم فيها خلال خمس سنوات من انقضاء المدة المنصوص عليها في القرار الوزاري المشار إليه في المادة الثانية من قانون الإصدار .
ولا تكون هذه الحقوق حجة على من تلقى حقا عينيا من المالك المقيد في السجل قبل حصول التأشير المنصوص عليه في المادة (32) من هذا القانون .
