يجب التأشير بالمحررات المثبتة لدين من الديون العادية على المورث في صحف السجل العيني المخصصة لأعيان التركة أو حقوقها .
ويجب على الدائن إعلان كل ذي شأن بقيام الدين قيل التأشير به .
ويحتج بهذا التأشير من تاريخ حصوله , ومع ذلك إذا تم التأشير في خلال سنة من تاريخ القيد المشار إليه في المادة السابقة فللدائن أن يحتج بحقه على كل من تلقى من الوارث حقا عينيا وقام بقيده قبل هذا التأشير .
