لا تخل أحكام هذا القانون والمرافق بحقوق العمال السابق لهم الحصول عليها من أجور ، ومزايا مستمدة من أحكام القوانين ، واللوائح ، والنظم والاتفاقيات والقرارات الداخلية السابقة على العمل بأحكامه .
وتظل الأحكام الواردة بالتشريعات الخاصة ببعض فئات العمال سارية ، إلى أن يتم إبرام ونفاذ الاتفاقيات الجماعية بشأنها ، وفقا لأحكام القانون المرافق .
وتعتبر المزايا الواردة بتلك التشريعات الحد الأدنى الذى يتم التفاوض على أساسه .
