يستثنى من تطبيق أحكام هذا الفصل ما يأتى :
١– الأعمال العرضية وما فى حكمها .
٢– الوظائف الرئيسية التى يعتبر شاغلوها وكلاء مفوضين عن صاحب العمل .
وللوزير المختص أن يصدر قرارا بسريان أحكام هذا الفصل على كل ، أو بعض الأعمال والوظائف والفئات المشار إليها فى البندين (١ ، ٢) من هذه المادة .
