يخطر صاحب العمل العمال ، والمنظمة النقابية العمالية المعنية بالطلب المقدم منه ، وبالقرار الصادر بالإغلاق الكلى ، أو الجزئى للمنشأة ، أو بتقليص حجمها ، أو نشاطها . ويكون تنفيذ ذلك القرار اعتبارا من التاريخ الذى تحدده اللجنة التى نظرت الطلب ، أو التظلم على حسب الأحوال .
