للعامل إنهاء العقد إذا أخل صاحب العمل بالتزام من التزاماته الجوهرية الناشئة عن هذا القانون ، أو عقد العمل الفردى أو الجماعى ، أو لائحة النظام الأساسى للمنشأة ، أو إذا وقع على العامل ، أو أحد ذويه اعتداء من صاحب العمل ، أو ممن يمثله .
ويعتبر الإنهاء فى هذه الحالات بمثابة إنهاء للعقد من جانب صاحب العمل بغير مبرر مشروع .
