تختص الشئون القانونية بالمنشأة بالتحقيق مع العامل ، وفى حالة عدم وجودها فلصاحب العمل أن يعهد بالتحقيق فى موضوع المخالفة إلى شخص آخر من ذوى الخبرة أو أحد العاملين بالمنشأة ، بشرط ألا يقل المستوى الوظيفى للمحقق عن مستوى العامل الذى يحقق معه .
