١ - على المنتفع أن يبذل من العناية فى حفظ الشىء ما يبذله الشخص المعتاد .
٢ - وهو مسئول عن هلاك الشىء ولو بسبب أجنبى اذا كان قد تأخر عن رده الى صاحبه بعد انتهاء حق الانتفاع .
