١ - ينقطع التقادم المكسب إذا تخلى الحائز عن الحيازة أو فقدها ولو بفعل الغير .
٢ - غير أن التقادم لا ينقطع بفقد الحيازة إذا استردها الحائز خلال سنة أو رفع دعوى باستردادها فى هذا الميعاد .
