تنتقل الحيازة من الحائز إلى غيره إذا اتفقا على ذلك وكان فى استطاعة من انتقلت إليه الحيازة أن يسيطر على الحق الواردة عليه الحيازة ،ولو لم يكن هناك تسلم مادى للشىء موضوع هذا الحق .
