إذا التصق منقولان لمالكين مختلفين بحيث لا يمكن فصلهمادون تلف ولم يكن هناك اتفاق بين المالكين ، قضت المحكمة فى الأمر مسترشدة بقواعد العدالة ومراعية فى ذلك الضرر الذى حدث وحالة الطرفين وحسن نية كل منهما .
