١ - للشركاء أن يتفقوا أثناء إجراءات القسمة النهائية على أن يقسم المال الشائع مهايأة بينهم ، وتظل هذه القسمة نافذة حتى تتم القسمة النهائية .
٢ - فإذا تعذر اتفاق الشركاء على قسمة المهايأة ، جاز للقاضي الجزئي إذا طلب منه ذلك أحد الشركاء أن يأمر بها ، بعد الاستعانة بخبير إذا اقتضى الأمر ذلك .
