إذا كان هناك تأمين عيني خصص قانونا أو اتفاقا لضمان الدين وقدمت كفالة بعد هذا التأمين أو معه ولم يكن الكفيل متضامنا مع المدين ، فلا يجوز التنفيذ على أموال الكفيل إلا بعد التنفيذ على الأموال التي خصصت لهذا التأمين .
