١ - يكون المؤمن مسئولا عن الأضرار الناشئة عن خطأ المؤمن له غير المتعمد ، وكذلك يكون مسئولا عن الأضرار الناجمة عن حادث مفاجئ أو قوة قاهرة .
٢ - أما الخسائر والأضرار التي يحدثها المؤمن له عمدا أو غشا ، فلا يكون المؤمن مسئولا عنها ولو اتفق على غير ذلك .
