١ - الوكالة تبرعية ، ما لم يتفق على غير ذلك صراحة أو يستخلص ضمنا من حالة الوكيل .
٢ - فإذا اتفق على أجر للوكالة كان هذا الأجر خاضعا لتقدير القاضي ، إلا إذا دفع طوعا بعد تنفيذ الوكالة .
