١ — يكون إنشاء المؤسسة بسند رسمى أو بوصية .
٢ — ويعتبر هذا السند أو هذه الوصية دستورا للمؤسسة ، ويجب أن يشتمل على البيانات الآتية :
(أ) اسم المؤسسة ومركزها على أن يكون هذا المركز فى مصر .
(ب) الغرض الذى أنشئت المؤسسة لتحقيقه .
(ج) بيان دقيق للأموال المخصصة لهذا العمل .
(د) تنظيم إدارة المؤسسة .
