١ - لا تصح إجارة الوقف بالغبن الفاحش إلا إذا كان المؤجر هو المستحق الوحيد الذي له ولاية التصرف في الوقف ، فتجوز إجارته بالغبن الفاحش في حق نفسه لا في حق من يليه من المستحقين .
