١ - إذا انتهت المزارعة قبل انقضاء مدتها وجب على المؤجر أن يرد للمستأجر أو لورثته ما أنفقه المستأجر على المحصول الذي لم يتم نضجه مع تعويض عادل عما قام به المستأجر من العمل .
٢ - ومع ذلك إذا انتهت المزارعة بموت المستأجر جاز لورثته عوضا عن استعمال حقهم في استرداد النفقات المتقدم ذكرها أن يحلوا محل مورثهم حتى ينضج المحصول مادامو يستطيعون القيام بذلك على الوجه المرضي .
