إذا نبه أحد الطرفين على الآخر بالإخلاء ، واستمر المستأجر مع ذلك منتفعا بالعين بعد انتهاء الإيجار فلا يفترض أن الإيجار قد تجدد ما لم يقم الدليل على عكس ذلك .
