تبرأ ذمة المستأجر الأصلي قبل المؤجر سواء فيما يتعلق بضمانه للتنازل له في حالة التنازل عن الإيجار أم فيما يتعلق بما يفرضه عقد الإيجار الأصلي من التزامات في حالة الإيجار من الباطن :
(أولا) إذا صدر من المؤجر قبول صريح بالتنازل عن الإيجار أو بالإيجار من الباطن .
(ثانيا) إذا استوفى المؤجر الأجرة مباشرة من المتنازل له أو من المستأجر من الباطن دون أن يبدي أي تحفظ في شأن حقوقه قبل المستأجر الأصلي .
