١ - لا تضامن بين الشركاء فيما يلزم كلا منهم من ديون الشركة ، ما لم يتفق على خلاف ذلك .
٢ - غير أنه إذا أعسر أحد الشركاء ، وزعت حصته في الدين على الباقين ، كل بقدر نصيبه في تحمل الخسارة .
