١ - تعتبر الشركة بمجرد تكوينها شخصا اعتباريا ، ولكن لا يحتج بهذه الشخصية على الغير إلا بعد استيفاء إجراءات النشر التي يقررها القانون .
٢ - ومع ذلك للغير إذا لم تتم الشركة بإجراءات النشر المقررة أن يتمسك بشخصيتها .
