لا تسري أحكام المادة السابقة في الأحوال الآتية :
(١) إذا كان الحق المتنازع فيه داخلا ضمن مجموعة أموال بيعت جزافا بثمن واحد .
(ب) إذا كان الحق المتنازع فيه شائعا بين ورثة أو ملاك وباع أحدهم نصيبه للآخر .
(ج) إذا نزل المدين للدائن عن حق متنازع فيه وفاء للدين المستحق في ذمته .
(د) إذا كان الحق المتنازع فيه يتبع عقارا وبيع الحق لحائز العقار .
